Rush Ticket Sale: Official Terms and Conditions

There will be no exceptions to these rules under any circumstances.

The Metropolitan Opera (the “Met") is offering the opportunity to purchase one ticket or one pair (two) of tickets to selected Metropolitan Opera performances at $25.00 per ticket while supplies last and on a first come, first serve basis pursuant to the following terms and conditions (the “Promotion").

These Official Terms and Conditions govern the Promotion and customers must accept them to participate.

The Promotion is open only to natural persons who are at least 18 years of age.  The offer is void where prohibited or restricted by law.  The directors, officers, employees and agents of the Met, their parents, subsidiaries and affiliates and the families and household members of the foregoing are not eligible to participate in the promotion.

Only one (1) pair of tickets per person, per household and per email address are allowed. Customers are ineligible to purchase rush tickets for a period of seven (7) days from the last date they purchased tickets through the Promotion.

Tickets may be purchased through this Promotion ON A FIRST COME, FIRST SERVED BASIS.  This Promotion is available on a daily basis only WHILE SUPPLIES LAST. To purchase tickets through this Promotion you will be required to login or register on the Met’s website (www.metopera.org).

You may purchase rush tickets through this Promotion to performances on Monday through Friday via the Met website (www.metopera.org) beginning at 12:00 PM ET the day of the performance or if there is a matinee performance on a Monday through Friday, you may purchase rush tickets beginning four hours prior to the matinee. You may purchase rush tickets through this Promotion to Saturday performances via the Met website (www.metopera.org) beginning four hours prior to the matinee performances and 2:00 PM ET on Saturday for evening performances. Rush tickets may not be purchased via any other means whatsoever for any reason. You may print your tickets at home or pick them up at the box office. Purchases generated by script, macro, bot or other automated means are prohibited. The Metropolitan Opera’s determination of time of receipt and eligibility are final. If there is a dispute as to the identity of a purchaser, the purchaser will be deemed to be the authorized account holder of the email address used to register or login. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. All ticket sales are final.

The Met reserves the right to change these terms and conditions and/or end the offer at any time without notice. All Met casting is subject to change. Tickets are not transferable or refundable in whole or part and have no cash value. Tickets will be void and forfeited if transferred or sold for cash.

Not all performances will have tickets offered at the $25.00 price and the New Years Eve Gala is specifically excluded. Specific seat locations are chosen by The Metropolitan Opera and are not negotiable. Performances on Monday through Thursday will have a minimum of 100 tickets available at this price and Friday and Saturday performances will have a minimum of 20 tickets available at this price during each season and the exact number, if any, per performance will be determined by The Metropolitan Opera. The fair market value of each ticket (after deducting the $25 purchase price) will vary depending on seat location and number of tickets purchased, but will be between $80.00 and $345.00 per ticket.

The Met shall not be responsible for any purchases that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at the Met’s servers or elsewhere. The Met, in its sole discretion, reserves the right to disqualify any person tampering with the purchase process or the operation of the website or otherwise attempting to undermine the legitimate operation of the Promotion including by cheating, hacking, deception or other unfair playing practices or by intending to abuse, threaten or harass other customers. WARNING: If any customer deliberately attempts to damage the Met’s website or undermine the legitimate operation of the sale, the Met reserves the right to seek damages and other remedies from any such customer to the fullest extent of the law. The Met further reserves the right to cancel, terminate or modify the Promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. The Met is not responsible for errors in the administration or fulfillment of this Promotion, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this Promotion based upon such error at its sole discretion without liability. In no event will the Met be responsible for offering more tickets at the Rush sale ticket price than the number of tickets specified in these terms and conditions. The value of the tickets set forth above represents the Met’s good faith determination of the approximate retail fair market value thereof; the Met’s valuation is final and binding and cannot be challenged or appealed. THE MET MAKES NO WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WITH REGARD TO THE PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY TICKET OR ANY COMPONENT OF ANY TICKET  EXCEPT AS REQUIRED BY LAW OR SPECIFICALLY SET FORTH HEREIN.

By purchasing or attempting to purchase a ticket, customers agree to these terms and conditions and all other terms and conditions of the Met as listed on its website and the decisions of the Met, its officers, directors, employees and agents and release them to the fullest extent permitted by law from any and all claims and liability arising out of the Promotion, including without limitation arising out of any goods and services provided by the Met and/or any other service providers and their affiliates, including without limitation any and all liability, legal claims, costs, injuries, losses or damages, demands or actions of any kind, including, without limitation, personal injuries, death, damage to, loss or destruction or property, violation of the rights of publicity or privacy or  defamation. By participating in this Promotion, each customer agrees that this Promotion and any and all aspects of the relationship between the Met and customers shall be governed by the laws of the state of New York, without giving effect to its conflicts of law principles, and that any litigation, claims, disputes or controversies concerning, arising out of or in connection with the Promotion shall be resolved individually, and without resort to class action and shall be brought only in a federal or state court in the county of New York, State of New York, and customers consent to the exclusive jurisdiction of such courts and waive any objection or defense concerning jurisdiction or venue that entrant could otherwise have in such courts. To the extent permitted by applicable law, all judgments or awards to customers shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental, consequential or multiple damages, which each customer hereby specifically waives.
